This document constitutes a public offer under Article 447 of the Civil Code of the Republic of Kazakhstan. Individual Entrepreneur SSTUDIO (BIN 841228400975), hereinafter the "Provider", offers any legally capable individual, hereinafter the "User", to enter into an agreement on the terms set out below.
2.1. The Provider grants the User, for a fee, temporary remote use of an IoT rod (remote equipment rental), including: access to a real-time video stream from the water body, remote control of casting, aiming and the reel, and session support by an on-site operator.
2.2. Fish caught during a Session is, at the User's choice: released back into the water body, or handed over to the User (pick-up or delivery by arrangement — where such an option is available for the specific water body and indicated in the App).
2.3. The service is deemed rendered at the moment access to control the IoT rod is provided, regardless of the fishing result: bites and catch are not the subject of this agreement and are not guaranteed.
3.1. Full and unconditional acceptance of this offer (Article 396 of the Civil Code of the RoK) is constituted by any of the following User actions: registering an account in the App; topping up the Balance; starting a Session.
3.2. By accepting this offer the User confirms being at least 18 years old or acting with the consent of a legal representative, and having read the Pricing, Terms of Use and Privacy Policy.
4.1. To receive the service the User: registers in the App, tops up the Balance, selects an available IoT rod and starts a Session (or joins the queue if the rod is busy).
4.2. Payment is charged from the Balance per minute at the Tariff of the selected IoT rod for the actual Session time.
4.3. A Session ends: at the User's initiative; when the Balance is exhausted; at the end of the water body's working hours (schedule shown in the App); in case of equipment malfunction.
4.4. The Provider may carry out maintenance on the equipment; during maintenance the rod is unavailable for booking and no funds are charged.
5.1. The price of services is determined by the Tariffs published on the "Pricing" page and in the App. All prices are in tenge (KZT). The current Tariff is shown to the User in the App before a Session starts.
5.2. Payments are made on a prepaid basis — by topping up the Balance through the connected payment service (by bank card or another available method). An electronic receipt is delivered by the payment service.
5.3. The Provider may change Tariffs unilaterally; new Tariffs take effect upon publication and do not apply to Sessions already paid for.
5.4. Bonus and promotional credits (promo codes) are not money, and are not subject to refund or exchange for money.
6.1. The unused Balance remainder (except bonus credits) is refundable upon the User's written request to gofish@fishonline.kz within 10 (ten) business days of receipt of the request, in accordance with the Law of the RoK "On Consumer Rights Protection".
6.2. If a Session was interrupted through the Provider's fault (equipment or Service malfunction), the Provider, at the User's choice, refunds the unused Session time to the Balance or provides equivalent time.
6.3. Refunds are made by the same method used for payment, unless otherwise agreed with the User.
7.1. The Provider undertakes to: maintain the Service in working order; provide the declared scope of the service during a Session; process User requests.
7.2. The User undertakes to: use the Service in accordance with this offer and the Terms of Use; refrain from actions aimed at disrupting the Service or the equipment; pay for services in due time.
7.3. The Provider may suspend the User's access to the Service in case of violation of this offer or the Terms of Use.
8.1. The Service is provided "as is". The Provider is not liable for: absence of catch; connection interruptions caused by failures of telecom operators' and ISPs' networks; force majeure (weather, power outage at the water body, etc.).
8.2. The Provider's aggregate liability to the User is limited to the User's Balance remainder.
8.3. The parties are released from liability under force majeure circumstances (Article 359 of the Civil Code of the RoK).
The User's personal data is processed in accordance with the Law of the RoK "On Personal Data and Its Protection" and the Privacy Policy, which is an integral part of this agreement.
Exclusive rights to the App, the website, the IoT rod software and other elements of the Service belong to the Provider. The User is granted a limited, non-transferable licence to use the App for its intended purpose.
11.1. The agreement is effective from the moment of acceptance until the parties fully perform their obligations.
11.2. The Provider may amend the terms of this offer; amendments are published on this page and take effect upon publication. Continued use of the Service constitutes consent to the amendments.
11.3. In all matters not covered by this offer the parties are governed by the legislation of the Republic of Kazakhstan. Disputes are resolved through negotiations, and failing agreement — in court at the Provider's location.
